AerscreenEZ Licensing Agreement

This is a legal agreement between you (either an individual or an entity), the end user, and Enviroware srl regarding use of the software accompanying this Agreement ("Software"). By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not install or use the Software.

This license agreement applies to the AerscreenEZ Software product that may be downloaded from http://www.enviroware.com or any other authorised site.

The Software is provided to you free of charge with an Evaluation License for a limited number of days, at the end of the evaluation period you can buy a Permanent License. Should you accept the terms of this agreement, Enviroware srl will grant you the personal and non-exclusive right to install and use the software.

The Software or any other materials provided in this package may not be modified in any way. The Software may NOT be redistributed to friends or associates without the written permission of Enviroware srl. You may NOT upload the software to a freeware or shareware site without first receiving written permission from Enviroware srl.

No parts of The Software or other files provided in this package may be reproduced in part or in whole. You may not remove any copyright or other proprietary notice from the software. You may not reverse engineer, decompile, or disassemble the software.

The Permanent License of AerscreenEZ is bound to a single computer.

The Software and the accompanying documentation is Copyright (©) 2012 by Enviroware srl. The Software is protected by both the Italian copyright law and international copyright treaty provisions.

DISCLAIMER

The Software is provided "AS IS". You agree that by accepting this license, you are expressly acknowledging that the use of the software is AT YOUR OWN RISK.

ENVIROWARE SRL MAKES NO WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE SOFTWARE AND ANY ACCOMPANYING DOCUMENTATION.

The user must assume the entire risk of using the program.

IN NO EVENT SHALL ENVIROWARE SRL, OR ITS PRINCIPALS, SHAREHOLDERS, OFFICERS, EMPLOYEES, AFFILIATES, CONTRACTORS, SUBSIDIARIES, OR PARENT ORGANIZATIONS, BE LIABLE FOR ANY INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES WHATSOEVER RELATING TO THE USE OF AerscreenEZ.

IN NO EVENT SHALL ENVIROWARE SRL, OR ITS PRINCIPALS, SHAREHOLDERS, OFFICERS, EMPLOYEES, AFFILIATES, CONTRACTORS, SUBSIDIARIES, OR PARENT ORGANIZATIONS, BE LIABLE FOR ANY DAMAGES (INCLUDING DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF ENVIROWARE SRL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Any liability of Enviroware srl will be limited exclusively to refund of purchase price.

Good data processing procedure dictates that any program be thoroughly tested with non-critical data before relying on it.

In addition, in no event does Enviroware srl authorize you to use AerscreenEZ in applications or systems where AerscreenEZ's failure to perform can reasonably be expected to result in a significant physical injury, or in loss of life. Any such use by you is entirely at your own risk, and you agree to hold Enviroware srl harmless from any claims or losses relating to such unauthorized use.

TRADEMARKS

Any product or brand names mentioned in the software and associated manuals and files are trademarks or registered trademarks of their respective owners.

YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS. YOU FURTHER AGREE THAT IT IS THE COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT BETWEEN US THAT SUPERSEDES ANY PROPOSAL OR PRIOR AGREEMENT, ORAL OR WRITTEN, AND ANY OTHER COMMUNICATIONS BETWEEN US RELATING TO THE SUBJECT MATTER OF THIS AGREEMENT.
