End User License Agreement

Customer may have another written agreement directly with Anymix that supplements or supersedes all or portions of this agreement. The Software is LICENSED, NOT SOLD, only in accordance with the terms of this agreement. Use of some Anymix and some non-Anymix materials and services included in or accessed through the Software may be subject to additional terms and conditions.

The Software may cause Customer's Computer to AUTOMATICALLY CONNECT TO THE INTERNET. The Software may also require activation or registration. Additional information on activation, Internet connectivity, and privacy is available in http://www.anymixmedia.com.

How can I use the software?
Under our license we grant you the right to install and run that one copy on one computer (the licensed computer), but only if you comply with all the terms of this agreement. Our software license is permanently assigned to the licensed computer. Please refer to the Additional Terms for licenses and conditions that are specific to certain countries, Limited Rights Versions and Special Editions of the software. The components of the software are licensed as a single unit. You may not separate or virtualize the components and install them on different computers. The software may include more than one version, such as 32-bit and 64-bit, and you may install and use only one version at a time. Except for the permitted use described under "Remote Access" below, this license is for direct use of the software only through the input mechanisms of the licensed computer, such as a keyboard, mouse, or touchscreen. It does not give permission for installation of the software on a server or for use by or through other computers or devices connected to the server over an internal or external network. The software also is not licensed for commercial hosting. For more information on multiple user scenarios and virtualization, see the Additional Terms.

How do I obtain a backup copy?
You may backup installed software in any storage device or download software form our website. You may not distribute the backup copy of the software. You may use it only to reinstall the software on the licensed computer.

Can I transfer the software to another computer?
You may not transfer the software to another computer. You may transfer the software directly to a third party only as installed on the licensed computer, with the Certificate of Authenticity label and this agreement. Before the transfer, that party must agree that this agreement applies to the transfer and use of the software. You may not retain any copies.

How does Internet activation work? Activation associates the use of the software with a specific computer or device. During activation, the software will automatically contact Anymix or its affiliate to confirm the license is associated with the licensed computer. This process is called "activation." Because activation is meant to identify unauthorized changes to the licensing or activation functions of the software, and to otherwise prevent unlicensed use of the software, you have no right to use the software after the time permitted for activation and you may not bypass or circumvent activation. If you have not entered a activation key during the time permitted for activation, most features of the software will stop running.

This software is licensed to single user and single hard disk only. Copyright law protects this Computer Program. Unauthorized reproduction or distribution of this program or any portion of it, may result in severe criminal penalties. And will be prosecuted maximum extent under possible law.

This end user license agreement ("LICENSE") is a legal agreement between you (either an individual or a legal entity) and Anymix, India for the software product identified above, which includes computer software, electronic and printed documentation, associated media and printed materials ("SOFTWARE").

Read this LICENSE carefully before using the SOFTWARE. By installing, copying, or otherwise using the SOFTWARE, you agree to be bound by the terms and conditions of this LICENSE. If you do not agree to the terms of this LICENSE, you are not authorized to use the SOFTWARE.

LICENSE

The SOFTWARE is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. This LICENSE contains rights and restrictions associated with use of the accompanying SOFTWARE.

1. RIGHTS :

A. Installation & Use :

Anymix, India grants you a non-exclusive and non-transferable limited LICENCE to use the SOFTWARE by the number of users and the class of computer hardware for which the corresponding license fees and payments have been made. For this purpose you may install the SOFTWARE on the local (1) hard disk or other (1) permanent storage media of one (1) computer. Any other use is strictly prohibited.


2. RESTRICTIONS & LIMITATIONS :

A. Reverse Engineering, De compilation, and Disassembly :

You may not translate, reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the SOFTWARE, except when and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.

B. Separation of Components :

The SOFTWARE is licensed as a single product. Its component parts may not be separated. You must maintain all copyright notices on all copies of the SOFTWARE.

C. Rental :

The SOFTWARE may not be leased, assigned or sublicensed, in whole or in part, except as specifically authorized by Anymix, India

D. No Server Based Access :

The SOFTWARE may not be installed on a intranet or internet server, except as specifically authorized by
Anymix, India.

The SOFTWARE may not be installed on a network drive, except as specifically authorized by Anymix, India.



4. DISCLAIMER OF WARRANTY & LIABILITY :

A. Disclaimer of warranty :

SOFTWARE is provided "AS IS," without a warranty of any kind. All express or implied representations and warranties, including an implied warranty of merchantability, fitness for a particular purpose or non-infringement, are hereby excluded.

B. Disclaimer of liability :

In no event will Anymix, India be liable for any lost revenue, profit or data, or for direct, indirect, special, consequential, incidental or punitive damages, however caused and regardless of the theory of liability, relating to the use, download, distribution of or inability to use SOFTWARE, even if Anymix, India has been advised of the possibility of such damages.

5. TERMINATION :

Without prejudice to any other rights, Anymix, India may terminate this LICENSE if you fail to comply with the terms and conditions of this LICENSE. In such event, you must destroy all copies of the SOFTWARE and all of its component parts.

6. COPYRIGHT :

SOFTWARE is confidential copyrighted information of the Anymix, India and title to all copies is retained by the Anymix, India. All title and copyrights in and to the SOFTWARE and any copies thereof are owned by Anymix, India. All title and intellectual property rights in and to the content which may be accessed through use of the SOFTWARE is the property of the respective content owner and may be protected by applicable copyright or other intellectual property laws and treaties.

7. EXPORT REGULATION :

None of the SOFTWARE or underlying information or technology may be downloaded or otherwise Exported or re exported to outside of the India.


8. Definitions.

1.1 "Anymix" means Anymix Media Broadcast Pvt. Ltd., a Company registered as ANYMIX MEDIA BROADCAST PRIVATE LIMITED, Howlia Park More, Tehatta, Nadia, WB, India, Pin-741160, if this agreement is entered into while Customer is in the WB, India.

1.3 "Compatible Computer" means a Computer with the recommended operating system and hardware configuration as stated in the Documentation.

1.4 "Computer" means a physical device that accepts information in digital or similar form and manipulates it for a specific result based on a sequence of instructions, including without limitation desktop computers, laptops, tablets, mobile devices, telecommunication devices, Internet-connected devices, and hardware products capable of operating a wide variety of productivity, entertainment, or other software applications.

1.5 "Customer" means you and any legal entity that obtained the Software and on whose behalf it is used; for example, and as applicable, your employer.

1.6 "Internal Network" means a private, proprietary network resource accessible only by employees and individual contractors (i.e., temporary employees) of a specific corporation or similar business entity. Internal Network does not include portions of the Internet or any other network community open to the public, such as membership or subscription driven groups, associations, and similar organizations.

1.7 "Output File" means an output file Customer creates with the Software.

1.8 "Activation Number" means one (1) unless otherwise indicated under a valid license (e.g., volume license) granted by Anymix.

1.9 "Software" means (a) all of the information with which this agreement is provided, including but not limited to: (i) all software files and other computer information; (ii) any proprietary scripting logic embedded within exported file formats or used in an Anymix Online Service; (iii) sample and stock photographs, images, sounds, clip art and other artistic works bundled with Anymix software or made available by Anymix on Anymix's website for use with the Anymix software and not obtained from Anymix through a separate service (unless otherwise noted within that service) or from another party ("Content Files"); (iv) related explanatory written materials and files ("Documentation"); and (v) fonts; and (b) any modified versions and copies of, and upgrades, updates, and additions to, such information, provided to Customer by Anymix at any time, to the extent not provided under separate terms (collectively, "Updates").
