Read this License Agreement carefully before using CAT Business Solutions Inc. Software. BY USING CAT Business Solutions Inc. PRODUCTS ('SOFTWARE') (“APPLIES TO ALL CAT Business Solutions Inc. PRODUCTS”) IN ANY WAY YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD AND AGREED TO THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE CAT Business Solutions Inc. SOFTWARE IN ANY WAY, AND, INSTEAD, RETURN IT OR DELETE COPIES OF CAT SOFTWARE IN YOUR POSSESSION.

License Grant

CAT Business Solutions Inc. grants you a non-exclusive license to use the software, and any associated documentation ('THE SOFTWARE'), as indicated herein. If you have purchased a Single User License, one copy of the Software may be installed and used, for internal use only, on a single computer. The Software is in 'use' on a single computer when it has been loaded into temporary memory (i.e. RAM) or installed into permanent memory (hard disk or other device) of that computer. If you have purchased a Multiple User License (by specifying several copies of the software while purchasing it), the Software may be installed and used, for internal purposes only, on the number of computers authorized at the time of purchase.
You MAY: (a) make a copy of the software for archival purpose only; (b) install the Software on another computer only if you change your workstation. In such a case you must uninstall the software from the previous workstation.

Software Improvement Program

CAT Business Solutions Inc. is committed to helping protect your privacy at all times except as otherwise provided in this Agreement. This statement explains the anonymous data collection process and usage practices for the Software Improvement Program of CAT Business Solutions Inc.
In order to provide and improve the software, its features, and user’s experience, we will automatically collect, maintain, process and use information concerning the way the various modules and functionalities of CAT Business Solutions Inc. software are being used. Information is also gathered anonymously for the purpose of statistical analysis about Software usage.
We will only use such information for the purpose of providing end users with the best possible software experience. The collected data will not be disclosed, shared, sold, traded or rented to any third parties for marketing purposes.
Activation

The Licensed Software contains technological measures that are designed to prevent its unlicensed or illegal use. The Licensed Software may contain enforcement technology that limits Licensee’s ability to install and uninstall the Licensed Software on a machine to no more than a finite number of times, for a finite number of devices and for a defined period in time designated by the purchased License. The Licensed Software may require an additional activation engine during installation and in the Documentation and proper functionality of the software. If any of such applicable activation procedure(s) is not followed, the Licensed Software may only operate for a finite period of time. If activation is required, but the Licensee doesn’t complete activation within the finite period of time set forth in the Documentation or explained during installation, the Licensed Software will cease to function until activation has been completed, by which time functionality will be restored. If Licensee has any problem with the activation process, Licensee may contact the Licensor customer service for support.
CAT Business Solutions Inc. secure licensing engine will be installed based on the User’s approval. This is required to activate the software and keep user informed about the activation state and its duration.

Restrictions

You MUST NOT: (a) copy and distribute the Software or any portion of it; (b) sublicense, lease, rent, or transfer this Software (c) cause or permit reverse engineering i.e. disassemble, decompile or alter this Software in any possible way; (d) remove any product identification, copyright notices, or other notices or proprietary restrictions from this Software; (e) copy the documentation accompanying the software.
Term

This License is effective until terminated. You may terminate it any time by destroying the Software, together with its copies. This License will also terminate if you fail to comply with any terms or conditions of this Agreement. Upon such termination, you agree to destroy the Software, together with all copies thereof. In case of physical copies (CDs, DVD) you will have to return the entire boxed contents that were supplied to you from CAT Business Solutions Inc.
Copyright/Ownership

CAT Business Solutions Inc. Software and its source code are proprietary products of CAT Business Solutions Inc. and are protected by copyright and other intellectual property laws. The Software is licensed and not sold. You acquire only the right to use the Software and do not acquire any rights, express or implied, in the Software other than those specified in this License.

Disclaimer of Warranties
The Software is supplied 'AS IS'. CAT Data Recovery and CAT Video Repair disclaim all warranties, expressed or implied, including, without limitation, the warranties of merchantability and of fitness for any purpose. The user must assume the entire risk of using the Software.

Third Party Software

You acknowledge that the Software may contain copyrighted software that includes Toolkit Pro (Codejock Software), IncUpdate (SuniSoft) and INNO Setup tool software components of third parties which are obtained under a license from such parties (“Third Party Software”).

This application supports silent installation, i.e. the application can be installed without displaying the installation windows and without showing prompts.

Severability

In the event of invalidity of any provision of this license, the parties agree that such invalidity shall not affect the validity of the remaining portions of this license.

Disclaimer of Damages
No Liability for Consequential Damages
To the maximum extent permitted by applicable law, in no event shall CAT Business Solutions Inc. or its employees, contractors, agents, distributors or suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, loss of data, loss of business opportunity, loss or damages to property, injuries to any person or any pecuniary loss,) arising out of the use of or inability to use the SOFTWARE, even if the CAT Business Solutions Inc. Software has been advised on the possibility of such damages. In any case, CAT Business Solutions Inc’s liability under any provision of this EULA shall be limited EXCLUSIVELY TO PRODUCT REPLACEMENT.

CAT Business Solutions Inc. Reserves all rights not expressly granted here.

Acknowledgement
By Installing the Software, you acknowledge that you have read the above EULA and agree with the terms and conditions of the agreement. You also agree that the EULA supersedes any prior agreement, written or verbal, which may exist between you and the CAT Business Solutions Inc. on the subject of THE SOFTWARE.
