PGCSoft CRM-Express License Agreement
Please read this document carefully. This is a legal agreement between you (either an individual or an entity) and PGCSoft. the developer of CRM-Express. This Agreement supersedes any prior version license and governs your use of the SOFTWARE.
The TRIAL version is provided to users to evaluate the application's functionality, capabilities and suitability to task. The TRIAL version can run as the Standard edition. The Standard trial edition will work for 30 days and will then expire.
DISTRIBUTION PERMISSION The TRIAL version may be freely distributed without prior permission from CRM-Express on condition that the files are not modified in any way.
INDEMNIFICATION By installing and using the CRM-Express software ("SOFTWARE") on your computer, you agree to save and hold harmless PGCSoft from any loss, direct or consequential damage, or claim incurred by you resulting from reliance upon the results obtained through the use of the SOFTWARE. If you disagree with any of these terms, do not install this software or remove the SOFTWARE together with all copies of it from your computer.
SOFTWARE ACTIVATION The SOFTWARE is licensed per computer or machine. The licensed product will only work on the machine on which it was licensed and does not expire. We require the machine ID of the computer on which the trial version is installed on from you to provide an activation code. This activation code is dependant on the unique 8-character machine id generated by the SOFTWARE. Activating the program with the activation code will convert the trial edition to the edition you have purchased. Just request a new activation code if your machine id changes due to a hard disk crash, moving the software to another machine, etc.
PGCSoft will E-MAIL the activation code to you within 12 hours if you have purchased a software license and sent us the machine identification number on which you have installed the TRIAL version. It is your responsibility to ensure that you provide us with a valid E-Mail Address and that your E-Mail filters do not block our E-MAIL.
GRANT OF LICENSE The SOFTWARE license gives you certain limited rights to use the Software. You do not become an owner of and PGCSofts retains title to all the Software, Software Copies and Related Materials. PGCSoft grants you the right to use this SOFTWARE to download log files from web site/s and analyze it as follows:
1. You may not lend, give, rent, lease, sub-license and transfer the LICENSED SOFTWARE and related materials to other parties without the written permission of PGCSoft.
2. You may not alter, disassemble, de-compile, reverse engineer, duplicate or create a derivative work with the same "look and feel" or otherwise use the SOFTWARE except as stated in this License agreement.
3. This SOFTWARE must only be used under the conditions and on operating systems for which the SOFTWARE was designed.
4. You need a license for every machine that the StandardL edition is installed on.
5. Standard Edition. CRM-Express Standard Edition may be run, on a single computer, for the company that purchased the license and third parties.
6. The licenses of users are automatically revoked without the option of a refund if they do not adhere to the License Agreement and may also be prosecuted.
7. It is your responsibility to keep a copy of the SOFTWARE in case you need to re-install it. CRM-Express reserves the right to charge a fee to provide you with an older copy.
COPYRIGHT. The SOFTWARE and Trademark are owned by PGCSoft. and is protected by International copyright laws and treaty provisions.
SOFTWARE SUPPORT. Minor updates of the product and priority e-mail software support are free to LICENSED users for one year after purchase. Support will only be provided by e-mail on licensed software and only on the most current version. Queries regarding the installation and use of the SOFTWARE, as well as requests for additional features and enhancements, should be submitted through the CRM-Express support page at www.CRM-Express.com . PGCSoft will attempt to implement all reasonable requests but is not obliged to do so. Please note that we cannot guarantee software updates.
LIMITED WARRANTY / LIMITATION OF LIABILITY. This SOFTWARE is provided and licensed AS IS. It is your responsibility to ensure that the product works on you particular system configuration to your requirements. We cannot guarantee that the program works with other third party software or later Operating Systems. These warranties are in lieu of any other warranties, expressed or implied, including the implied warranties of merchantability and fitness for a particular purpose. In no event will PGCSoft be liable to you for damages, including any loss of profits, lost savings, or other incidental or consequential damages arising out of your use of or inability to use the SOFTWARE, even if PGCSoft has been advised of the possibility of such damages. Any liability of the seller will be limited exclusively to refund of purchase price minus administration fees of 15 percent of purchase price if you have informed us within thirty days of purchase. No refunds will be provided after thirty days of purchase.
RESERVATION. PGCSoft reserves the right to change the license agreement of the software. PGCSoft reserves the right to change the product as it sees fit, including but not limited to removal, adding or changing features in new editions. PGCSoft reserves the right to change prices without notice.
