END USER LICENSE AGREEMENT

Please read this End-User License Agreement ('Agreement') carefully before installing or using EvolveWorx Batch File Destroyer ('Software').
By agreeing to install or use the Software, you are agreeing to be bound by the terms and conditions of this Agreement.

If you do not agree to the terms of this Agreement, do not proceed to install and use the Software.

License
You may install and use a copy of the Software on a computer or concurrently on different computers, and make multiple back-up copies of Software, for Your business or personal use.

Description of Rights and Limitations
⦁ Limitations. You may not re-license, sell, rent, lease, assign, reproduce, transmit, host, outsource, disclose or commercially exploit the Software. And You may not reverse engineer, decompile, or disassemble Software, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding the limitations.
⦁ Distribution. You may distribute any number of copies of the Software; provided each copy shall be a true and complete copy, including all intellectual property notices, and shall be accompanied by a copy of this Agreement. Copies of Software may be distributed as a standalone product or included with your own bundle/collection media, as long as Software is not sold or included in a product or package that intends to receive benefits through the inclusion of Software.
⦁ Software Transfer. You may permanently transfer all rights under the Agreement, provided recipient agrees to the terms of this Agreement.

EvolveWorx Modifications to Software
EvolveWorx reserves the right to modify, update, maintain, upgrade, suspend or discontinue, temporarily or permanently; the Software or any service to which it connects, with or without notice and without liability to you.

Non-Support
EvolveWorx has no obligation to Software support, or to continue providing or updating any of the Software.

Integration
Both parties agree that this Agreement is the complete and exclusive statement of the mutual understanding of the parties and supersedes and cancels all previous written and oral agreements and communications relating to the subject matter of this Agreement.

Term and Termination
This Agreement shall remain in effect until terminated by you or EvolveWorx.
EvolveWorx may, in its sole discretion, at any time and for any or no reason, suspend or terminate this Agreement with or without prior notice.

This Agreement will terminate immediately, without prior notice from EvolveWorx, in the event that you fail to comply with any provision of this Agreement. You may also terminate this Agreement by deleting the Software from your computer.
Upon termination of this Agreement, you shall cease all use of the Software and delete all copies of the Software from your computers.

Severability
If any provision of this Agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Warranty Disclaimer
EvolveWorx and author of Software, hereby expressly disclaim any warranty for the Software. Software and any related documentation is provided “as is” without warranty of any kind, either express or implied, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. You accept any and all risk arising out of use or performance of Software.

Limited Liability
EvolveWorx shall not be liable to You, or any other person or entity claiming through You any loss of profits, income, savings, or any other consequential, incidental, special, punitive, direct or indirect damage, whether arising in contract, tort, warranty, or otherwise. Even if EvolveWorx has been advised of the possibility of such damages. These limitations shall apply regardless of the essential purpose of any limited remedy. Under no circumstances shall EvolveWorx aggregate liability to You, or any other person or entity claiming through You, exceed the financial amount actually paid (If applicable) by You to EvolveWorx for the Software.

Amendments to this Agreement
EvolveWorx reserves the right, at its sole discretion, to modify or replace this Agreement at any time.
