GACKUP USAGE AND LICENSE AGREEMENT 1.0

The Gackup application is provided under terms of this agreement. Any use of this application constitutes acceptance of this agreement.

1. ACCEPTABLE USE: Gackup is intended to be used for copying locally stored and locally owned files to Google Drive. Acceptable use is governed by the following conditions:
a. Gackup users must take full responsibility for content copied to Google Drive, and agree to Google’s acceptable use agreement and policies governing allowed content.
b. Gackup users are required to use Google account credentials that they legal access to. Use of Google Drive with an unauthorized party’s credentials is in violation of this agreement and in violation of Google policies.
c. Use of Gackup should be in compliance with all local, state, and national, international laws and also be in compliance with acceptable use policies for the local Microsoft Windows operating system, Google Drive, and user’s Internet Service Provider.
i. Gackup users are responsible for maintaining awareness of aforementioned policies, and any other policies governing use of software or equipment on which Gackup is installed.

2. LICENSE: The Gackup application is licensed to the author, Michael Mulryan and altering, repackaging or reproducing it is prohibited unless the author has provided written authorization.

3. NO WARRANTY: Gackup is provided on an 'as is' basis, without warranties or conditions of any kind, Each user is solely responsible for determining the appropriateness of using the Program and assumes all risks associated with its exercise of rights under this Agreement, including but not limited to the risks and costs of program errors, compliance with applicable laws, damage to or loss of data, programs or equipment, and unavailability or interruption of operations. Please note the following:
a. The Gackup application is dependent on the availability of Google Drive and will not function properly if the Google Drive service is unavailable for any reason.
b. Access to the Gackup application could be revoked at any time and without warning due to changes in Google terms of service and technologies, or for other reasons.
c. Gackup users are responsible for maintaining their Google Drive credentials and no support will be provided to users unable to access Google Drive via Gackup.
d. Gackup users are responsible for the security of their local and Google Drive files and maintaining sharing rules within their Google Drive.
e. Gackup users are responsible for the integrity of their copied files and the author of Gackup is not responsible for missing or deleting files, or the successful completion of backup jobs.
f. Gackup is not expected to disrupt local system operation or performance, but the author of Gackup is not liable should Gackup experience problems or poor performance on a local operating system.
g. If any Gackup user is dissatisfied with the application, he/she may uninstall it at any time.

4. DISCLAIMER OF LIABILITY: The author of this application does not have any liability for any direct, indirect, incidental, special, exemplary, or consequential damages (including without limitation lost profits), however caused and on any theory of liability, whether in contract, strict liability, or tort (including negligence or otherwise) arising in any way out of the use of the application.

5. DONATIONS: Donations made to support Gackup will support the application’s continued development, with the following provisions:
a. Donations do not entitle the donator to any form of warranty or support agreement.
b. Making a donation does not guarantee a given feature will be developed, and does not influence the development schedule.
c. Donations can be refunded if a refund request is sent to Gackup via PayPal with 12 hours.

6. GENERAL: If any provision of this Agreement is invalid or unenforceable under applicable law, it shall not affect the validity or enforceability of the remainder of the terms of this Agreement, and without further action by the parties hereto, such provision shall be reformed to the minimum extent necessary to make such provision valid and enforceable.
