Lisence Agreement
Important: Thanks for your selection of Kuaizip software (hereinafter referred to as “Kuaizip or the Software”).
1. We specially remind users to read the Kuaizip License and Service Agreement (hereinafter referred to as “Agreement”) carefully and have a full understanding of it. – You (hereinafter referred to as “Users”) shall carefully read and fully understand all contents of the Agreement, including the exceptions that exempt or limit Shanghai Guangle Network Technology Co., Ltd. (hereinafter referred to as “Shanghai Guangle”) from any liabilities and the clauses for restricting users’ rights. Please read the Agreement carefully and select to accept it or not (juveniles shall read it companied by legal guardians). Only when you accept all clauses of the Agreement can you download, install or use the Kuaizip software and its related services. If you have the behaviors of download, installation, use, account obtaining or login for the Software, you are deemed to agree with the Agreement and have accepted the constraints of all Agreement clauses.
2. The Agreement is entered into between Users and Shanghai Guangle and its operating partners (hereinafter referred to as “Partners”) about users’ download, installation, usage, duplication of “Kuaizip software” and their use of related services of Shanghai Guangle. It explains the rights and obligations of Shanghai Guangle and users in terms of the use of “Kuaizip software” license and related services. A User refers to an individual or organizations that obtains the Software product and its license number and registers account through the path specified by Shanghai Guangle and that uses related services of Shanghai Guangle.
3. The Agreement shall be subject to any update of Shanghai Guangle. Once being issued, the updated clauses shall replace the original ones without prior notice. Users can re-download and reinstall this Software or check the latest agreement clauses by visiting the website (www.kuaizip.com). If Users do not accept the clauses of the modified Agreement, they shall stop using the Software and related services of Shanghai Guangle immediately, otherwise, they shall be considered to have accepted the modified Agreement.
4. Except as otherwise herein specified, the Agreement does not offer the service items of Shanghai Guangle or its Partners outside the usage of the Software. These services shall be standardized by independent clauses. Users can make further understanding and confirmation upon the use of concrete services. If independent service items have conflicts with this Agreement, the former shall prevail. If a User uses the services, it is deemed that the User has accepted the service items.
5. The Software shall be protected by Copyright Law of The PRC, International Copyright Treaties and other intellectual property laws and treaties, and its IPR shall be owned by Shanghai Guangle.
6. The ownership and IPR of the Software (including but not limited to any images, photos, animations, videos, records, music, words and additional programs (dll, exe, etc.) of the Software), attached help materials, and any copy of the Software shall exclusively belong to Shanghai Guang. Any item of them shall be prohibited from being used (including but not limited to duplication and modification) by Users.
7. Users shall not perform reverse engineering on the Software or decompile or disassemble it. Any violation to the regulation shall be deemed as an infringement act and the violator shall bear all the adverse consequences.
8. This Software product is free, so Users can download, install, duplicate and distribute it without the need of payment. Any commercial sales, duplication and distribution of the Software, such as pre-installation and binding, shall be prohibited unless being authorized and permitted previously by Shanghai Guangle.
9. Due to the differences and complexity of hardware and software of personal PCs, Shanghai Guangle shall not guarantee that the functions offered by the Software can be executed normally or up to Users' expectations in any situations. For all consequences due to Users' application of this Software, Shanghai Guangle shall not assume any liabilities.
10. This Software is a free product, for which Shanghai Guangle shall offer technical support.
11. To improve the quality of Software and help netizens better manage their computers, Kuaizip can report server the behaviors of installation, uninstallation of the Software, and system optimization and related operations according to the universal practice of improving user experience by international well-known client software. Specifically, Users can access a page of the server or send a message to the server, which can count the numbers of occurrence times of previous behaviors according to the number of page access times. When a personal PC has an unrecognized running item or start item or an application unable to be classified, Kuaizip will return the software name and command-line data to the server. Kuaizip does not associate this data with personal identity information of the User, trace or monitor the User’s computer, monitor the User’s behaviors online or offline, collect personal information like other software and documents of the User, or reveal the User’s privacy. Users shall be informed and understand that, to further optimize the functions and services of related systems of our company and improve Users’ experience, while protecting Users’ information and data from being violated, we may use the related system of Shanda Online to collect some Users' data and share the data with the services and products of associated companies. Such data collection and sharing shall not target at specific Users and not be revealed or for other illegal purposes. The data will be used to enhance system quality and performance so as to provide more valuable services to Users.
12. The Software features the function of automatically upgrading plug-ins and Software version so as to install new plug-ins for Users in time. The Users that do not need this function can disable it through upgrade setting of the Software. During upgrade of Software function modules, Users can select upgrade or not through upgrade prompt interfaces. If Users do not need such upgrade prompt, they can disable it through upgrading setting of the Software. Kuaizip guarantees that the upgrade modules of the Software do not contain any malicious code aimed at destroying Users' computer data or obtaining Users' privacy data or any functional code that can trace or monitor Users’ computers, monitor Users’ behaviors online or offline, collect personal information like other software and documents of Users, or reveal Users' privacy.
13. To enhance Users' upgrade speed and broadband use efficiency, the upgrade module of the Software adopts the P2P technology. P2P may result in upload of data, which includes only the program modules of the Software downloaded by Users and P2P control information, but no any Users' key information.
14. Although the Software has passed strict test, we shall not guarantee that it is completely compatible with all hardware and software systems. In case of any incompatibility, Users can report it to Shanghai Guangle by using the contact information offered by the official website (www.kuaizip.com) to obtain technical support. If the problem fails to be resolved, Users can delete the Software. Unless apparently intentional acts, Kuaizip shall not assume any responsibilities for damages to Users caused by other reasons, which may be the conflicts between the Software and Users’ installation and use of other software; or the damages due to use failure of the Software, which may include (but not limited to) direct or indirect personal damage, trade interruption, and loss of commercial profit, commercial information, or money, occurring in any case.
15. As the Software may be downloaded and spread through network or another path, Kuaizip shall not be sure whether the Software product downloaded from non-Kuaizip specified websites or non-Kuazip issued media is infected with compute viruses or Trojan horse program or carries hacker software, and therefore shall not bear any liabilities for any direct and indirect damages caused thereof.
16. To make users download plug-ins in common formats safely and conveniently, the Software offers a plug-in installation management module, from which Users can download common formats and function-enhancement modules. Although these module may be provided by net friends, they all have undergone the test of Kuaizip anti-virus programs and been approved to be safe and not malicious. To update Software information timely, the plug-in installation management module can automatically update programs and Software data.
17. Users’ installation of the Software shall indicate that they have accepted all Agreement clauses. If you do not accept the Agreement, please click Cancel on the Software installation interface or deselect “I agree with Kuaizip license agreement” on the installation interface.
18. The effect, interpretation, change, performance and dispute resolution of the Agreement shall comply with the laws of The People’s Republic of China. In case of any dispute in connection with the Agreement or execution thereof, both parties shall try to resolve it through negotiation; if it fails, any dispute under the Agreement shall be subject to the jurisdiction of people’s court at the location of Shanghai Guangle.
The Wavpack compression technology from Conifer Software shall be released according to BSD licensing.
The Jpeg compression technology from Przemyslam Skibinski shall be released according to GNU agreement.
