License Agreement LiteBox3D, Version 1.19.1


This agreement exists between the interested party (“Licensee” in the following) and TECHNIA GmbH (“TECHNIA” in the following). Licensee is for the purpose of this agreement, such legal entity or person using the software. Software is for the purpose of this agreement the product “LiteBox3D, Version 1.19.1”, which is left to the customer free of charge. This agreement only applies to such version of the software left to the Licensee free of charge. For any other version of the software, in particular versions of the software subject to costs, a different agreement has to be separately closed.

By using this software, the Licensee obliges himself to be bound by the conditions of this agreement. In case the Licensee does not agree to the following, the Licensee has to refrain from installing and using the software. In such case the Licensee has to delete any and all of the software on its server.

1. Grants of rights
The software is left to the Licensee as machine-readable code (object code) and free of charge. TECHNIA grants the Licensee a non-exclusive, non-transferable, temporally and locally unlimited right to use the software in unamended form, including its documentation. The Licensee also has the right to copy the software, but only for its internal use.

The program 'JAVA SE Runtime Environment Version 7' is delivered together with the Software. For the use of 'JAVA SE Runtime Environment Version 7' the regulations of the 'Binary Code License Agreement' apply.

2. Restrictions of right to use
The Licensee shall not distribute or transfer the software to any third party, regardless if such distribution or transfer is free of charge or not, or is made by using any hardware or via remote data transmission. The Licensee has no right to lease, rent or sublicense the software. The Licensee has no right to make the software publically available. Licensee may not modify, adapt, reverse engineer, decompile, disassemble or decode the software in any other manner, in whole or in part.

Third party is for the purpose of this agreement any subsidiary, affiliated or parent company, and joint venture, irrespective of the relevant holding.

3. Warranty and limitation of liability
It is the sole responsibility of the Licensee that the software meets the requirements of the Licensee. The software is provided to Licensee as is. TECHNIA is only liable insofar as a defect is fraudulently concealed.

TECHNIA is liable without limitation for damage resulting in fatal or physical injury or harm to health. As for the rest TECHNIA's liability towards the Licensee is limited to willful intent.

4. Applicable law, place of fulfillment and court of jurisdiction
This agreement is subject to German law. The legal relationships concerning this matter between the parties are to be interpreted as per the laws of the Federal Republic of Germany excluding provisions of private international law and UN purchase law. Sole place of fulfillment is Karlsruhe. Court of jurisdiction is Karlsruhe.
