End User License Agreement

The following is a fully binding contract, and by using MEdit you agree to be bound by all items contained herein.

I, David O'Neil, am the creator and owner of all rights to the Software (MEdit). I grant you a non-exclusive license to use the Software for 30 days for your evaluation of the software.

To use the Software beyond those 30 days, you must purchase a license for each copy of the software you are using. Those licenses simply extend the non-exclusive license for an unlimited time period for the major version of the Software you license.

You may install the Software on any / all of the computers you have the authority to install software on. You may concurrently run the Software on up to as many computers as you have valid licenses. In other words, if you have only purchased one license and are running it on two or more machines, the copies may not run simultaneously - you can only run one at a time between the multiple machines. If I find this being abused (i.e., you give away your registration information to others), your authorization to use the program will be terminated and that registration information will be blacklisted.

If you distribute the Software, you agree to distribute an exact copy of the Software you received for installation purposes, including this EULA in its entirety.

You may not modify, decompile, or disassemble the Software. You may not reverse engineer the software to create a work similar to the Software.

The Software is being delivered to you 'AS IS' and I make no warranty whatsoever as to its use or performance. Under no circumstances will I be responsible for any losses arising from the Use of the Software. Where applicable law does not allow for the above, under no circumstances will I be liable for more than the purchase price you paid for the Software.

Me and any affiliates I am partnered with or will partner with will not be liable for any damages or claims of any sort arising from the use of the Software. If you do not agree to this, do not use the Software, and destroy all copies of the software. I will not return any money you paid for licensing this software as you have 30 days in which to evaluate it free of charge and you have implicitly agreed to these terms by installing the software.

This software can be used to help you learn to synchronize the right and left hemispheres of your brain. Certain individuals may respond to the stimulus that is being presented by going into an epileptic seizure. Myself, and any affiliates, will not be responsible for any damages caused if this occurs. Therefore, if you have a history of epilepsy it is recommended that you do not use this feature of the Software. If you start going into seizures, immediately discontinue use of the Software, and consult a physician. If you create a work with these features in it, and distribute that work, me and any affiliates will not be liable in any way for any damages such a work may cause.

This Agreement will be governed only by the laws in force in the State of Texas, in the United States of America. The U.N. and other bodies of law have no jurisdiction over this agreement.

If any part of this Agreement is found void and unenforceable, that part will not affect the validity of the rest of the Agreement, which shall remain valid and enforceable according to its terms.

U.S. Government workers have no other rights than the ones listed herein as this license is a license for a 'Commercial Item'.
