SOFTWARE LICENSE AGREEMENT
You should carefully read the following terms and conditions which govern your use of the SOFTWARE. By clicking on the 'I Accept...' button at the end of the terms and conditions you agree to be bound by the conditions of this license. If after reading the following terms and conditions you do not wish to proceed with the use of the SOFTWARE you must not proceed to install or otherwise use the SOFTWARE.
1 Definitions
In this License Agreement the following terms have the following meanings:
a) 'MiceText' means MiceText Ltd, its successors and assigns.
b) 'Licence Key' means unique identifier of license that is being given to the end user.
c) 'SOFTWARE' means the SOFTWARE product identified in the product order form which is available for installation, use or downloading and which is the subject of this agreement.
d) 'Licencee' means a person or nonperson who have the right to use the SOFTWARE based on an agreement with MiceText.
e) 'Computer' means an electronic device with one or more CPU, cores or a device within emulated hardware system.
2 Licence
a) MiceText grants to licencee a non-exclusive license to use the SOFTWARE and the related items in accordance with the desktop ,server SOFTWARE you have purchased.
b) Licencee may create own patterns databases for the programs included in the SOFTWARE.
c) If the SOFTWARE is provided as an update, You must own a license of a product identified by MiceText as being eligible for this update in order to use the SOFTWARE.
d) A single copy of the SOFTWARE may be made by You for back-up purposes only. You must only use this copy as a back up and it should not be installed in a form which is capable of use.
e) You may not assign or transfer the license of the SOFTWARE to any other party without the written permission of MiceText.
f) You must not decompile, disassemble, modify, translate or make any attempt to discover the source code (reverse engineer) of the SOFTWARE, or create derivative works from the SOFTWARE.
g) MiceText reserves the right to modify the terms and conditions of this license at any time by posting a modified version of the license on its website. Any future modifications to this license will supersede all prior versions after the revised version has been posted to the website. MiceText reserves the right to change the support policy any time without any prior notice.
h) The registered SOFTWARE may not be rented or leased, but may be permanently transferred, if the person receiving it agrees to terms of this license.
i) The SOFTWARE unregistered (Trial) version may be freely distributed, however the distribution package cannot be modified. No person or company may charge a fee for the distribution of the Trial SOFTWARE without written permission from the copyright holder.
j) You may only use the SOFTWARE for the maximum number of users licensed to use the SOFTWARE at any one time which was specified in the product order form.
k) In some cases, You may be required to provide MiceText with information about the characteristics of Your hardware, Licence Key of Your SOFTWARE as well as standard personal details including company name (if applicable), address, phone number and e-mail address. MiceText may use the above-mentioned information in accordance with applicable data protection law for its business purposes, product support and development.
l) You may not customize or integrate the SOFTWARE or distribute Runtime SOFTWARE into or with an application that is generally competitive with any of the MiceText product offerings.
m) You may only install and use the SOFTWARE on the maximum number of servers, computers, virtual or emulated servers or terminals licensed to use the SOFTWARE which was specified in the product order form. All servers which use the SOFTWARE must be licensed.
n) The above license may be revoked only in case the licensee does not fulfil its contractual obligations.
All rights not expressly granted above-mentioned are reserved by MiceText.
3 Intellectual property
a) You acknowledge that MiceText is the proprietor of all industrial, commercial and intellectual property rights including the copyright in the SOFTWARE and the related items and including all versions or adaptations of the SOFTWARE and the related items.
b) You acknowledge that the SOFTWARE may incorporate or refer to products in which the MiceText is not the proprietor of the intellectual property. MiceText makes no warranty as to the use or suitability of such products and the intellectual property rights of those products remain the property of their respective proprietors.
4 Warranty and disclaimer
a) The SOFTWARE, any upgrades and updates are being delivered to You 'as is' and MiceText makes no warranty of any kind. MiceText does not and cannot warrant the performance or results You may obtain by using the SOFTWARE.
b) MiceText does not warrant that the SOFTWARE will meet your requirements or that operation of the SOFTWARE will be uninterrupted or that the SOFTWARE will be error-free.
