FINGERSPOIL GAMES SOFTWARE LICENSE TERMS

ATTENTION: USE OF THE SOFTWARE IS SUBJECT TO THE SOFTWARE LICENSE TERMS SET FORTH BELOW. USING THE SOFTWARE INDICATES YOUR ACCEPTANCE OF THESE LICENSE TERMS.

The following License Terms govern your use of the accompanying Software unless you have a separate signed agreement with Fingerspoil Games.

LICENSE GRANT. Fingerspoil Games grants you a license to Use one copy of the Software with its limitation without a license fee (the “Trial License”). “Use” means storing, loading, installing, executing or displaying the Software solely for your personal use. You may not modify the Software or disable any licensing or control features of the Software.

If you pay the license fee amount in the manner described at the end of this License Agreement, Fingerspoil Games will grant you a license to use the Software in accordance with the terms of this License Agreement in perpetuity (the “Perpetual License”). You can use all the generated textures in non-commercial or commercial projects but you can not sell the textures separately or in packs.

The Software is licensed per user, so if more people are going to use the Software you will need to purchase additional copies.

Each license allows installation on all owned computers, but the Software may not be used at exactly the same time on each of them.

OWNERSHIP. The Software is owned and copyrighted by Fingerspoil Games. Your license confers no title to, or ownership in, the Software and is not a sale of any rights in the Software.

COPIES AND ADAPTATIONS. You may only make copies or adaptations of the Software for archival purposes or when copying or adaptation is an essential step in the authorized Use of the Software. You must reproduce all copyright notices in the original Software on all copies or adaptations. You may not copy the Software onto any public network.

NO DISASSEMBLY OR DECRYPTION. You may not disassemble or decompile the Software unless Fingerspoil Games’ prior written consent is obtained. Upon request, you will provide Fingerspoil Games with reasonably detailed information regarding any disassembly or decompilation.

TRANSFER. Your license will automatically terminate upon any transfer of the Software. Upon transfer, you must deliver the Software, including any copies and related documentation, to the transferee. The transferee must accept these License Terms as a condition to the transfer.

LIMITED WARRANTY AND LIMITATIONS ON DAMAGES. FINGERSPOIL GAMES WARRANTS THAT FOR A PERIOD OF THIRTY DAYS AFTER PURCHASE THAT THE PROGRAM WILL OPERATE SUBSTANTIALLY IN ACCORDANCE WITH THE DOCUMENTATION. SHOULD THE PROGRAM NOT SO OPERATE, YOUR EXCLUSIVE REMEDY, AND FINGERSPOIL GAMES' SOLE OBLIGATION UNDER THIS WARRANTY, SHALL BE, AT FINGERSPOIL GAMES' SOLE DISCRETION, CORRECTION OF THE DEFECT OR REFUND OF THE PURCHASE PRICE PAID FOR THE PROGRAM. THIS LIMITED WARRANTY IS THE ONLY WARRANTY PROVIDED BY FINGERSPOIL GAMES REGARDING THE PROGRAM. EXCEPT FOR THE LIMITED WARRANTY ABOVE, THE PROGRAM IS PROVIDED ON AN 'AS-IS' BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, FINGERSPOIL GAMES DISCLAIMS ALL OTHER WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. FINGERSPOIL GAMES DOES NOT WARRANT THAT THE PROGRAM WILL OPERATE ERROR FREE, OR IN AN UNINTERRUPTED FASHION. IN NO EVENT WILL FINGERSPOIL GAMES BE LIABLE FOR SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM POSSESSION, USE OR MALFUNCTION OF THE PROGRAM, INCLUDING DAMAGES TO PROPERTY, LOSS OF GOODWILL, COMPUTER FAILURE OR MALFUNCTION AND, TO THE EXTENT PERMITTED BY LAW, DAMAGES FOR PERSONAL INJURIES, EVEN IF FINGERSPOIL GAMES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME STATES / COUNTRIES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS AND / OR THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS AND / OR EXCLUSION OR LIMITATION OF LIABILITY MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER RIGHTS THAT VARY FROM JURISDICTION TO JURISDICTION.

TERMINATION. Fingerspoil Games may terminate your license upon notice for failure to comply with any of these License Terms. Upon termination, you must immediately destroy the Software, together with all copies, adaptations and merged portions in any form.

EXPORT REQUIREMENTS. You may not export or re-export the Software or any copy or adaptation in violation of any applicable laws or regulations.
