This is the Server-side component of SysExpertez. It consists of a database, and Administrator Console, all of which will be installed on the same computer (server). If you purchase additional license(s) for the Administrator Console separately, it can be installed on other computer(s) depending on the number of available licenses. Multiple installations of the Administrator Console connect with the same instance of database for SysExpertez, and provide the exact same result; it’s for operational convenience only. SysExpertez Agent installer package will be extracted during the installation of the server installer package. The Client Agent needs to be installed on all the required client workstations. The number of Client Agent installations is limited by the number of Client Access Licenses (CALs) available with your purchase. Scope of license 1. Registered Version: Applies to copies purchased directly from SARANGSoft Corporation or from any authorized reseller of SARANGSoft Corporation. Each Licensed copy of SysExpertez can be installed-to and used-from only a single computer. You can install one licensed copy on only one computer. If you want to install the same in another computer, you have to first uninstall SysExpertez from the computer, where it was previously installed. Each Licensed copy may be accessed through a network, provided that you have purchased rights to use a Licensed Copy for each workstation that will access SysExpertez through the network. For instance, if 2 different workstations will access SysExpertez on the network, you must purchase rights to use 2 Licensed Copies of SysExpertez regardless of whether the 2 workstations will access SysExpertez at different times or concurrently. 2. Evaluation / Beta Version: Applies to copies distributed by SARANGSoft Corporation for evaluation / Beta test purposes. This is not free software. Subject to the terms below, you are hereby licensed by SARANGSoft Corporation to use one copy of SysExpertez on one (1) computer or workstation, for evaluation purposes without charge for a period of 30 days. If you use this software after the 30-day evaluation period, you have to purchase the registered version. Unregistered use of SysExpertez after the 30-day evaluation period is in violation of U.S and international copyright laws. You may, without making any payment to SARANGSoft Corporation: a) Give exact copies of this evaluation version of SysExpertez personally to anyone, except for the purpose of extending their 30-day evaluation period. b) Make as many exact copies of this evaluation version of SysExpertez as you wish, for purposes of distribution as described in (a) above. You are specifically prohibited from charging, or requesting donations, for any copies, however made, and from distributing such copies with other products of any kind, commercial or otherwise, without prior written permission from SARANGSoft Corporation. SARANGSoft Corporation reserves the right to revoke the above distribution rights at any time, for any or no reason. 3. Common: Applies both to Registered and Evaluation/Beta Version as described above: Any portion of SysExpertez is the sole copyright of SARANGSoft Corporation. You may not alter, modify, reverse engineer, disassemble or decompile any portion of SysExpertez, nor permit anyone else to do so. All rights of any kind in SysExpertez, which are not expressly granted in this license, are entirely and exclusively reserved to and by SARANGSoft Corporation. You may not rent, lease or create derivative works based on SysExpertez, nor permit anyone else to do so. You may not make access to SysExpertez available to others in connection with a service bureau, application service provider, or similar business, nor permit anyone else to do so. Warranty Disclaimers and Liability Limitations SysExpertez and any and all accompanying software, files, data and materials, are distributed and provided 'AS IS' and with no warranties of any kind, whether expressed or implied. SARANGSoft Corporation assumes no risk if this software doesn't function properly and makes no warranties, either expressed or implied, with respect to the software and/or associated materials. Further, SARANGSoft Corporation shall not be liable for any claims / damages whatsoever including damages for loss of data, loss of business profit, business interruptions, or for any other special, consequential / incidental damages, however caused whether arising out of breach of warranty, contract, tort (including negligence) or otherwise. Any liability of SARANGSoft Corporation will be limited exclusively to refund of purchase price. In addition, in no event shall SARANGSoft Corporation, or its owners, officers, employees, resellers, affiliates, contractors, be liable for any indirect, incidental, consequential, or punitive damages whatsoever relating to the use of SysExpertez or to your relationship with SARANGSoft Corporation. In addition, in no event does SARANGSoft Corporation authorize you or anyone else to use SysExpertez in applications or systems, where SysExpertez 's failure to perform can reasonably be expected to result in a significant physical injury, or in loss of life. Any such use is entirely at your own risk, and you agree to hold SARANGSoft Corporation harmless from any and all claims or losses relating to such unauthorized use. General This license is the complete statement of the agreement between the parties on the subject matter, and merges and supersedes all other or prior understandings, purchase orders, agreements and arrangements. This license shall be governed by the laws of the State of Washington (United States of America). Exclusive jurisdiction and venue for all matters relating to this license shall be in courts and fora located in the State of Washington (United States of America), and you consent to such jurisdiction and venue. There are no third party beneficiaries of any promises, obligations or representations made by SARANGSoft Corporation herein. Any waiver by SARANGSoft Corporation of any violation of this license by you shall not constitute, nor contribute to, a waiver by SARANGSoft Corporation of any other or future violation of the same provision, or any other provision, of this license.
