Softwarelizenz der Firma APPLIED SECURITY GMBH (nachfolgend Firma)
Lesen Sie nachfolgende Lizenzbedingungen aufmerksam und sorgfältig durch, bevor Sie fideAS(r) file private (Software) auf Ihrem Computer einsetzen. Durch Verwendung der Software erklären Sie Ihr ausdrückliches Einverständnis mit den nachstehenden Lizenzbestimmungen. Für den Fall, dass Sie mit diesen Lizenzbedingungen nicht einverstanden sind, dürfen Sie die Software nicht verwenden.
1. Einräumung einer Lizenz
Diese Lizenz erlaubt Ihnen
- die Benutzung einer Kopie der Software auf einem Einzelcomputer unter der Voraussetzung, dass die Software zu jeder Zeit auf nur einem einzigen Computer verwendet wird. Die Benutzung der Software bedeutet, dass die Software entweder in einem temporären Speicher (z. B. RAM) eines Computers oder auf einem permanenten Speicher (z. B. Festplatte, CD-ROM) geladen ist.
2. Urheberrecht
Die Software ist urheberrechtlich geschützt, die aus dem Urheberrecht resultierenden Rechte stehen der Firma APPLIED SECURITY GMBH zu. Die Software enthält urheberrechtlich geschütztes Material sowie Betriebsgeheimnisse, zu deren Wahrung Sie sich verpflichten. Es ist verboten, die Software zu dekompilieren, rückassemblieren oder auf andere Weise in allgemein lesbare Form umzuwandeln, sowie Software oder Teile der Software sowie hieraus abgeleitete Produkte zu ändern, anzupassen, zu übersetzen, zu vermieten, zu verleasen, zu verleihen, weiterzugeben oder herzustellen.
Das Urheberrecht umfasst insbesondere den Programmcode, die Dokumentation, das Erscheinungsbild, die Struktur und Organisation der Programmdateien, den Programmnamen, Logos und andere Darstellungsformen innerhalb der Software. Jede nicht ausdrücklich genehmigte Vervielfältigung, Nutzung, Weitergabe, Änderung oder Wiedergabe des Inhaltes der Software ist untersagt.
Das Handbuch, sowie sonstige zur Software gehörende Schriftstücke, sind urheberrechtlich geschützt. Jede Vervielfältigung, Änderung oder Weitergabe des Materials ist verboten und wird zivil- und strafrechtlich verfolgt.
3. Dauer der Lizenz
Die Einräumung der Lizenz erfolgt zeitlich unbefristet. Die Lizenz verliert automatisch ihre Wirksamkeit, ohne dass es einer Kündigung bedarf, wenn Sie gegen irgendeine Bestimmung dieses Vertrages verstoßen. Im Falle der Beendigung sind Sie verpflichtet, die Software sowie alle Kopien der Software zu vernichten. Sie können den Lizenzvertrag jederzeit dadurch beenden, dass Sie die Software einschließlich aller Kopien vernichten.
4. Haftung
Die Firma hat die Software, unter Ausnutzung aller nach dem gegenwärtigen Stand der Technik vorhandenen, Möglichkeiten auf Computerviren untersucht, ohne dass hierbei ein bekannter Computervirus festgestellt werden konnte. Soweit die Software gleichwohl mit einem derzeit noch nicht technisch feststellbaren Computervirus oder mit einem unbekannten Computervirus infiziert sein sollte, übernimmt die Firma hierfür keinerlei Haftung, es sei denn, dass ihr grobe Fahrlässigkeit oder Vorsatz vorzuwerfen ist. Für den Fall, dass im Zusammenhang mit Computerviren oder ähnlichen Phänomenen gleichwohl eine Haftung der Firma eintreten sollte, wird diese auf den Betrag beschränkt, der für die Software vom Lizenznehmer bezahlt wurde.
5. Sonstiges
Mit Akzeptierung dieser Lizenzbedingungen stimmen Sie zu, dass Sie Produktinformationen und gegebenenfalls auch andere Nachrichten von der Firma angezeigt bekommen, z.B. Veranstaltungshinweise oder Stellenanzeigen.
Dieser Lizenzvertrag unterliegt dem Recht der Bundesrepublik Deutschland. Für den Fall, dass Bestimmungen dieses Lizenzvertrages ganz oder teilweise unwirksam sind oder werden, berührt dies die Wirksamkeit der übrigen Bestimmungen nicht. Die unwirksame Bestimmung ist vielmehr durch eine solche zu ersetzen, die dem Sinn und Zweck der unwirksamen Bestimmung möglichst nahe kommt. Nebenabreden sind nicht getroffen. Änderungen dieser Lizenzvereinbarung bedürfen der Schriftform. Gleiches gilt für die Aufhebung dieser Schriftformklausel.

Please read the following license agreement carefully and thoroughly before using fideAS (r) file private (software) on your computer. By using the Software or by opening the Software package, you explicitly agree to the following license terms. In the event that you do not agree with these license terms, you may not use the software.

1 Grant a license
This license allows you
- The use of a copy of the software on a single computer on the condition that it is being used at any time only one computer. Use of the software means that the software loaded either in a temporary memory (eg, RAM) of a computer or on a permanent memory.

2 Copyright
The Software is protected by copyright, the copyright resulting from the rights belong to the company APPLIED SECURITY GMBH. The Software contains copyrighted material and trade secrets, you agree to the observance. It is forbidden to decompile, reassemble or convert to other use in human readable form, as well as software or portions of software and therefrom to change derivative works, adapt, translate, rent, lease, loan, distribute or create .
The copyright covers the particular program code, documentation, appearance, structure and organization of the program files, program names, logos and other forms of representation within the software. Any use not expressly authorized reproduction, use, disclosure, alteration or reproduction of the contents of the software is prohibited.
The manual and other documents belonging to the software are protected by copyright. Any reproduction, modification or distribution of the material is prohibited and will be prosecuted under civil and criminal law.
3 Duration of license
The granting of the license is unlimited in time. The license will automatically expire, without the need for notice if you breach any provision of this Agreement. In the event of termination, you must destroy the Software and all copies of the software. You may terminate the License Agreement at any time by destroying the Software including that all copies.

4 Limited Warranty
The company has the software, taking advantage of all existing in the current state of the art facilities inspected for computer viruses without specifying a known computer virus could be detected. If the software is infected with a not yet technically detectable computer virus or with an unknown computer virus, however, the company no liability unless, that you are guilty of gross negligence or intent on taking this. In the event that, in connection with computer viruses or similar phenomena should occur nevertheless a liability of the company, this is limited to the amount that was paid for the Software by Licensee.

5 Other
By accepting this license agreement, you agree that you will get product information and possibly other news of the company displayed, eg Event announcements or job offers.
This license agreement is governed by the laws of the Federal Republic of Germany. In the event that any provision of this License Agreement is wholly or partially invalid, this shall not affect the validity of the remaining provisions. The invalid provision is rather to be replaced by one that comes as close as possible to the sense and purpose of the invalid provision. Additional agreements are not taken. Changes to this Agreement must be in writing. The same applies to the removal of this clause.
