License of YouTube Dubber software



THE USE OF THE SOFTWARE PROVIDED WITH THIS AGREEMENT (YOUTUBE DUBBER 'THE SOFTWARE') CONSTITUTES YOUR ACCEPTANCE OF THESE TERMS. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, DO NOT INSTALL AND/OR USE THIS SOFTWARE. THE USE OF THIS SOFTWARE IS CONDITIONED ON THE RESPECT OF THE USER UNDER THIS AGREEMENT.



1. LICENSE AGREEMENT.

The DUBBING SISTERS™ grants you a license to use a copy of this software on a single system.
'You' means the company or person whose funds are used to pay the license fee.
'Use' means the storage, loading, installation, execution or display of the software.
You may not modify the software or deactivate any license or control functionality of the software, except as an integral part of the software's programming functions.
This license is not transferable to any other system or to any other organization or person.


2. PROPERTY.

The software is the property and copyright of The DUBBING SISTERS™.
Your license does not confer any title or ownership to the software and shall not be construed as a sale of any rights in the software.


3. COPYRIGHT.

The software is protected by the French copyright law and the provisions of international treaties. You acknowledge that no intellectual property rights in the software are transferred to you.
You further acknowledge that the title and ownership rights of the software remain the exclusive property of The DUBBING SISTERS™ and that you do not acquire any rights in the software, except in the cases expressly stipulated in this license.
You agree that all copies of the software contain the same proprietary notices that appear on and in the software.


4. REVERSE ENGINEERING.

You agree not to attempt reverse engineering, to not modify, to not translate or to disassemble the software in whole or in part.

 
5. NO OTHER WARRANTIES.

THE DUBBING SISTERS™ DOES NOT WARRANT THAT THE SOFTWARE IS ERROR-FREE. THE DUBBING SISTERS™ DISCLAIMS ALL OTHER WARRANTIES WITH RESPECT TO THE SOFTWARE, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON THE DURATION OF AN IMPLIED WARRANTY OR THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.
THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS THAT VARY FROM JURISDICTION TO JURISDICTION.


6. DIVISIBILITY.

In the event of invalidity of any provision of this license, the parties agree that such invalidity will not affect the validity of the other parts of this license.


7. NO LIABILITY FOR CONSEQUENTIAL DAMAGES.

IN NO EVENT SHALL THE DUBBING SISTERS™ OR ITS SUPPLIERS BE LIABLE FOR ANY INDIRECT, SPECIFIC, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER ARISING OUT OF THE DELIVERY, PERFORMANCE OR THE USE OF THE SOFTWARE, EVEN IF THE DUBBING SISTERS™ HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT WILL THE DUBBING SISTERS™ ' LIABILITY FOR ANY CLAIM, WHETHER IN CONTRACT, TORT OR ANY OTHER THEORY OF LIABILITY, EXCESS THE LICENSE FEE PAID BY YOU TO THE DUBBING SISTERS™, IF APPLICABLE.


8. APPLICABLE LAW.

This license will be governed by the laws of France. The United Nations Convention on contracts for the international sale of goods is expressly excluded.


9. FULL AGREEMENT.

This is the entire agreement between you and The DUBBING SISTERS™ that replaces any prior written or oral agreement or agreement relating to the subject matter of this license.
